Enactment of Government Regulation No. 30 of 2026: Changes on Intellectual Property Official Fees

Background

On 2 July 2026, the Government of the Republic of Indonesia enacted Government Regulation No. 30 of 2026 on Types and Tariffs of Non-Tax State Revenue (“PNBP”, i.e. official fees) Applicable to the Ministry of Law (“Regulation 30/2026”). Regulation 30/2026 revokes and replaces Government Regulation No. 45 of 2024 (“Regulation 45/2024”) and will come into force on 1 August 2026.

Overview of the Changes

Our review on the fees changes shows that the fee increases are not spread evenly across all areas of intellectual property. The significant increase is concentrated in Trademarks, with increases ranging from approximately 40% to 57.1% (roughly 50%), covering the following services: (i) trademark applications, (ii) renewals (whether filed on time or within the grace period), (iii) recordal of license agreements, (iv) filing of oppositions, (v) filing of appeals, (vi) recordal of merger/assignments, (vii) recordal of change of name/address, (viii) administrative fees for international trademark applications originating from Indonesia, and (ix) transformation of an international trademark into a national trademark. In addition to these services, there is an 180% increase for the replacement of a national trademark with an international trademark.

While the significant increase is concentrated in services related to Trademarks, we have seen no change in fees for Patents services. Instead, Regulation 30/2026 now provides official fees applicable to new practices introduced by Indonesia’s New Patent Law (Law No. 65 of 2024), such as: (i) restoration/reinstatement of a patent application following failure to comply with formality requirements, (ii) request for restoration of priority rights, (iii) request for early substantive examination of a patent application, (iv) request for re-examination, and (v) late annuity fee payment.

Industrial Designs, Layout Designs of Integrated Circuits, and Trade Secrets also have seen no change in fees across any of their services, while Copyright fees have actually decreased for the recordal of works for songs/music, which is now free of charge. The Geographical Indication fee is recorded as increasing nominally from Rp450,000 to Rp1,450,000; however, the difference corresponds exactly to the substantive examination fee, which was previously a separate service (Rp1,000,000) and no longer appears as a standalone item, indicating a consolidation of two fees into a single upfront payment for the same stage of the application. Regulation 30/2026 also introduces a number of new official fees that were not previously regulated, including fees for intellectual property law enforcement.

Follow-Up Recommendations

Trademarks

Based on these findings, we recommend that clients focus their attention on their trademark portfolios: for trademark applications or renewals that are either planned in the near future or have already entered the renewal period, consider filing before 1 August 2026 to take advantage of the current fees, and update budget projections for annual/multi-year official fee costs relating to trademark portfolios.

Patents

Since the Regulation will come into force on 1 August 2026, we believe this is an appropriate time for applicants to familiarize themselves with the newly available options at the DGIP. However, it is worth to consider that DGIP will need time to complete the necessary system updates to formally implement these practices through its e-filing system. Until the relevant features are made available in the system, applicants may not be able to take advantage of these new practices.
